Conditions of Use

This voucher must be exchanged at the Box Office or Candy Bar for your ticket on the day of viewing.

This voucher is redeemable for one (1) general admission ticket for one (1) adult:
- for any session at HOYTS, Berkeley or selected independent cinemas in New Zealand;
- for any 3D movie session with an upgrade fee, which will be applied at time of redemption;
- and is valid until the expiry date indicated and cannot be exchanged, extended or replaced.

HOYTS must approve in writing any material which includes reference to ‘HOYTS’ or ‘HOYTS Movie Gift Pass’.

Conditions of Use

This pass must be exchanged at the Box Office or Candy Bar for yourticket on the day of viewing and does not guarantee a seat to the session of your choice. We recommend that you book your tickets in advance.

This voucher is redeemable for one (1) La Premiere admission ticket at HOYTS cinemas in New Zealand:
- for any 3D movie session with an upgrade fee, which will be applied at time of redemption;
- and is valid until the expiry date indicated and cannot be exchanged, extended or replaced.

This voucher cannot be:
- redeemed for D-Box, Xtremescreen or special or group events;

HOYTS Gift Cards Terms and Conditions

These Terms and Conditions govern the use and operation of your HOYTS Gift Card.

1. Agreeing to the Terms and Conditions

1.1 You agree to be bound by these Terms and Conditions by purchasing, activating, using or attempting to use your HOYTS Gift Card or making any transactional query.
1.2 By using a HOYTS Gift Card, you warrant to us that you will comply with these Terms and Conditions and all applicable laws and that your HOYTS Gift Card will not be used in any manner which is unlawful, misleading, deceptive or unfair.
1.3 If you are giving a HOYTS Gift Card to another person you must ensure that the recipient of the HOYTS Gift Card is aware of the Terms and Conditions that apply to the HOYTS Gift Card and the relevant expiry date.
1.4 HOYTS Corporation Pty Ltd reserves the right to amend all or part of these Terms and Conditions at any time.

2. Purchasing a HOYTS Gift Card

2.1 HOYTS Gift Cards can be purchased from any HOYTS cinema in New Zealand.
2.2 HOYTS Gift Cards purchased from any HOYTS cinema in New Zealand can be individually loaded with any value between $20 and $500.
2.3 HOYTS Gift Cards may also be purchased from any third party outlet approved by HOYTS, as amended from time to time.
2.4 HOYTS Gift Cards purchased from any third party outlet approved by HOYTS, can be individually loaded with $30, $50 or $100.
2.5 The value which can be loaded on to each HOYTS Gift Card may change from time to time.
2.6 Once a HOYTS Gift Card has been purchased, it cannot be refunded.

3. Redeeming a HOYTS Gift Card

3.1 HOYTS Gift Cards can be redeemed at any HOYTS cinema in New Zealand at the Box Office or Candy Bar for tickets to any available movie session at any time as well as for items at the Candy Bar. Any value redeemed will be deducted from the available balance. HOYTS cinema locations may change from time to time, please refer to hoyts.co.nz for a full list of HOYTS cinema locations.
3.2 HOYTS Gift Cards can be redeemed at any Berkeley cinema located in New Zealand. Berkeley cinema locations may change from time to time, please refer to hoyts.co.nz for a full list of gift card redemption locations.
3.3 If your purchase/s exceeds the available balance on your HOYTS Gift Card, you must pay the excess using another method of payment.
3.4 HOYTS Gift Cards are valid for 12 months from the date of purchase. Our record of your expiry date is final. Once your HOYTS Gift Card has expired the HOYTS Gift Card cannot be re-activated and any unspent value cannot be used or redeemed by you.
3.5 Once a HOYTS Gift Card has been purchased and loaded with value or when the HOYTS Gift Card has reached a $0 balance, no further value can be added to it.
3.6 HOYTS Gift Cards cannot be redeemed for cash. No cash advances will be made at any time.
3.7 HOYTS Gift Cards cannot be redeemed for prepaid movie vouchers or HOYTS Gift Cards.
3.8 You do not need to use the entire available balance in one transaction. No change will be given, however, the remaining available balance may be applied to future purchases until the HOYTS Gift Card expires or the balance reaches $0.
3.9 Your PIN will be required to be entered on any redemption transaction.

4. Transaction Information

4.1 You can check the expiry date, available balance and transaction history of your HOYTS Gift Card by visiting hoyts.co.nz
4.2 To find out information on your HOYTS Gift Card using the link above, you will be required to enter your HOYTS Gift Card number and PIN.
4.3 Your HOYTS Gift Card number and PIN are located on the back of your HOYTS Gift Card.

5. Lost or Stolen HOYTS Gift Cards

5.1 You should treat your HOYTS Gift Card like cash.
5.2 HOYTS Gift Cards cannot be replaced or refunded if lost, stolen or damaged.
5.3 We reserve the right to place a stop on your HOYTS Gift Card if:
(a) you report that your HOYTS Gift Card has been lost, stolen or damaged; or
(b) we believe (or reasonably suspect) that you have used (or will use) your HOYTS Gift Card contrary to these Terms and Conditions.
5.4 At our absolute discretion, we may change our policies and procedures on lost, stolen or damaged HOYTS Gift Cards. If we decide to do this, we will publish details on our website.

6 Errors and Complaints

6.16. If you wish to dispute an amount deducted from your HOYTS Gift Card, you must contact our Head Office or visit the Box Office at any HOYTS cinema in New Zealand. If an amount is not disputed within ninety (90) days after the transaction date, we may (at our sole discretion) refuse to provide you with a refund.

HOYTS Cinemas Terms of Sale of Tickets

HOYTS Cinemas Pty Ltd (GST # 60 361 703) is a film exhibitor with operations in New Zealand.
Tickets can include admission to any or all of the following sessions (in season and advance sales): general admission, La Premiere, XtremeScreen, Bean Bag cinema, 3D and HOYTS IMAX ® and includes any ticket provided by HOYTS Cinemas to you for admission into the cinema.
By purchasing Tickets, you agree to be bound by:
1) the following terms and conditions;
2) any additional terms and conditions that may apply to the particular type of Ticket purchased; and
3) in the case of the purchase of Tickets online, any terms and conditions of use applicable to the web site www.hoyts.co.nz or such other web site as may be authorised or operated by HOYTS Cinemas for the sale of Tickets online from time to time (HOYTS Web Site), (collectively Terms of Sale).

Variation

HOYTS Cinemas may vary these Terms of Sale at any time. Any variation will become effective upon publication on the HOYTS Web Site. By making a purchase after the Terms of Sale have been varied; you agree to be bound by the variation.

Terms of Sale

Tickets are sold subject to the following terms and conditions:
1.1 Cameras, audio and video recorders are not permitted inside the cinemas.
1.2 GST will apply to all goods and services supplied through HOYTS Cinemas. Prices quoted are inclusive of GST.
1.3 Where concessions are applicable, suitable identification must be provided upon request.
1.4 By purchasing a Ticket, you represent that you are of an age permitted to purchase the ticket pursuant to the relevant classification for the film by the Office of Film and Literature Classification and you must provide suitable identification upon request.
1.5 HOYTS Cinemas reserves the right to refuse admission or sale if:
(a) You fail to comply with any Terms of Sale;
(b) Tickets are damaged or defaced in any way; or
(c) Tickets are not purchased from HOYTS Cinemas or other authorised point of sale.
1.6 HOYTS Cinemas does not make any express warranties to you including, without limitation, any warranties that any advertisements, session times, cinema locations, information or reviews in relation to any film are accurate or reliable.
1.7 To the extent permitted by law:
(a) HOYTS Cinemas excludes all conditions and warranties implied into these Terms of Sale;
(b) HOYTS Cinemas excludes all liability to you for any injury, loss or damage (including any indirect or consequential loss or damage) that you may suffer; and
(c) For any liability that it cannot exclude, HOYTS Cinemas limits its liability to refunding the price of the Ticket or supplying you with another Ticket.
1.8 Lost, stolen or destroyed Tickets will not be replaced.
1.9 In addition, the following terms and conditions apply to the purchase of Tickets online or over the phone:
(a) Tickets may be purchased online or over the phone and paid for by way of any of the following credit cards Visa, MasterCard or American Express.
(b) A booking or service fee may be charged for Tickets purchased online or over the phone and each online or phone booking may be limited to a maximum number of Tickets.
(c) Once a booking is approved online or over the phone and completed, you will be provided with a confirmation number which you should quote for future enquiries in relation to the booking.
(d) Tickets purchased online or over the phone may be collected from the cinema box office, candy bar (where applicable) or from Kiosks where these are available.
(e) You must use the same credit card for purchase and collection of Tickets. Please note that your credit card will be charged for the Tickets purchased online or over the phone even if you do not collect the Tickets.

1.10 Refunds

(a) To the extent permitted by law, all refunds will be in the sole discretion of HOYTS Cinemas. If a refund is made, HOYTS Cinemas may retain any service or like fee it has charged (including booking fees) and any postage or other incidental costs that it has incurred in relation to that purchase, which are not refundable.
(b) Where HOYTS Cinemas has agreed to provide you with a refund, HOYTS Cinemas will refund the value of the Ticket based on the price at which the Ticket was offered for sale by HOYTS Cinemas at the time of purchase.
(c) Without limiting its discretion to refuse any refunds, HOYTS Cinemas may consider granting a refund in the following circumstances:

(i) Transactions that have been charged more than once due to an Internet error or similar
(ii) Incorrect Ticket purchase in regards to session times, film title and/or cinema location where this was caused by HOYTS Cinemas and if the Tickets are returned no later than 30 minutes prior to the commencement of the session.
(iii) Disruption of a session by means of power failure, security alarm, or any other incident requiring full evacuation of the cinema.

Governing Law

The Terms of Sale will be governed by the laws in force in the State where the Tickets will be used and you irrevocably submit to the non-exclusive jurisdiction of the courts of that State.

Web Site terms and conditions – HOYTS Store Online purchases

1.1 Definitions

In the terms and conditions:
“Prepaid movie Voucher” or “Voucher” means any prepaid movie Voucher issued by HOYTS which includes, but is not limited to Movie Passes and Movie Gift Passes.
“Card” means a Gift Card issued by HOYTS.
“HOYTS” means HOYTS Corporation Pty Ltd.
A reference to “we”, “us” or “our” is a reference to HOYTS Corporation Pty Ltd
A reference to “you” or “your” is a reference to the person who is taken to agree to these terms and
conditions.

1.2 General

(a) You may purchase HOYTS prepaid movie Vouchers and Gift Cards from hoyts.co.nz. You should consider the terms and conditions of each product in deciding whether to acquire any products from HOYTS.
(b) By purchasing any prepaid movie Voucher or Gift Card product from this web site, you agreed to be bound by:
(i) these Web Site terms and conditions; and
(ii) the terms & conditions of use for each HOYTS prepaid movie Voucher or Gift Card. The Card terms & conditions include provisions governing, among other things, the period of validity and Participating Stores for each of the Cards.

1.3 Ordering and payment

(a) To purchase a Voucher or a Card you must complete the online ordering process, which requires you to:
(i) select the product you wish to order and in the case of Gift Cards, selecting the amount you wish to be loaded onto each Card;;
(ii) provide billing and delivery details. Delivery is only to one address for all products purchased in a single order;
(Iii) nominate a method of delivery;
(b) You must pay the total amount of the sale plus any delivery and handling fees) as indicated on the Web Site using a credit card (MasterCard, Visa Diners or Amex).
(c) If you choose to include a message, it is your responsibility to make sure your message is not unlawful, obscene, defamatory, indecent, offensive or inappropriate. Although HOYTS is not obliged to review your message, we reserve the right to refuse to include your message if it falls into any of the above categories.
(d) From time to time, the card design that you select may become unavailable. If this occurs we will send the Recipient a Card(s) with an alternative design.
(e) The contract with HOYTS for the purchase of any Vouchers or Cards only becomes binding when we provide you with an online tax invoice at the last stage of the online ordering process which (i) notifies you that we have processed your order, and (ii) provides you with a purchase reference number (that must be provided when making any enquires in relation to the order).
(f) HOYTS is not obliged to accept your order and may accept or reject your order, or cancel and deactivate your Voucher(s) or Card(s), for any reason, including if your registration is deemed fraudulent, if the product is unavailable, payment is not received, or if there is an error in your order.

1.4 Delivery

(a) Upon acceptance of your order and confirmation of receipt of your payment, we will activate the Voucher (s) or Card(s) and send them to the Recipient at the address provided.
(b) Orders will be delivered to New Zealand business and residential street addresses only. International addresses are not accepted.
(c) All mail is subject to courier timings and terms and conditions. HOYTS takes no responsibility for orders damaged or lost in transit, or late, lost or misdirected mail and will not replace or refund value for lost, stolen or damaged Voucher(s) or Card(s).
(d) The expiry date of the product will be clearly marked on the product.

1.5 Order Cancellations / Stopped Vouchers or Cards

We reserve the right to cancel an order and/or to place a stop on the Voucher(s) or Card(s) if:
(a) your order is not accepted at the nominated delivery address; or
(b) we believe (or reasonably suspect) that your order is fraudulent or you have otherwise breached these Web Site terms and conditions – Online purchases; or
(c) we believe (or reasonably suspect) that you will use the Voucher(s) or Card(s) for a fraudulent or unlawful purpose;
(d) you report that the Voucher(s) or Card(s) have not been delivered, have been stolen or damaged in transit.

1.6 Personal Information

We collect personal information so that we can send the Voucher(s) or Card(s) to the Recipient on your behalf. We collect and deal with personal information in accordance with the Privacy Policy appearing on hoyts.co.nz

1.7 Warranty and Indemnity

(a) By making an order for Voucher(s) or Card(s) on hoyts.co.nz, you represent and warrant that:

(i) you are 18 years of age or over, or, if you are under 18 years of age, you have your parent’s or guardian’s consent to enter into these Web Site terms and conditions – Online purchases and to use the credit card that is being used to make the purchase; and
(ii) you are properly authorised to use the credit card that is being used to make the purchase; and
(iii) all of the information you provide to us is accurate and complete.

(b) You indemnify us for all losses, costs, expenses or damages that we may suffer if:

(i) any of the information is not correct, or
(ii) any representation or warranty proves to be untrue; or
(iii) you breach any provision of these Web Site terms and conditions – Online purchases.

1.8 Errors and Complaints

(a) If you have questions or if you wish to make a complaint about the Voucher(s) or Card(s) ordered online, please contact us using the Contact Us section of this Web Site.

To the extent permitted by law, we exclude all express or implied conditions or warranties of any kind, including any warranty that the material on this Web Site will be reliable, accurate or complete, or that your access to this Web Site will be uninterrupted, timely or secure.
2.2 In particular, we do not warrant the reliability or accuracy of card information or that your use of the ‘Gift Card Balance Check’ function will be uninterrupted or error-free, or that material accessible on or through this Web Site will be free from errors, viruses, worms or other harmful code.
2.3 We are not liable to you or to any other person for any loss or damage (including any other form of indirect or consequential loss) either in negligence, other tort, breach of contract, breach of warranty or for any other reason or cause whatsoever, arising out of or in connection with a Voucher or Card, these Web Site terms and conditions – Online purchases or use of this Web Site, including any loss or corruption of data, interference with or damage to your computer or any interruption, delay or failure in this Web Site. These exclusions only apply to the extent permitted by law. Our liability to you in contract, tort (including negligence), under statute or otherwise, will be reduced by the extent (if any) to which you caused or contributed to the loss or damage. This clause will apply even after this agreement has ended.
2.4 Where legislation implies any condition or warranty that cannot be excluded in these Web Site terms and conditions – Online purchases, we limit our liability for breach of any such implied conditions or warranties to the replacement or repair of the goods (or costs thereof) or re-supply of the services (or costs thereof).
